I currently have an appeal lodged with the DWP regarding the lost payments when I started to be eligible for the Pension. My DWP pay day is Monday, which I am informed is the main pay day, however my birthday was the previous Wednesday. This means that the DWP have 'defrauded' me out of 5 days pension.
When I complained I was informed that the Government introduced legislation in 2000 which had the effect of grouping new pensioners into 52 weekly slots instead of paying the pension from your 65th birthday they paid from the next Monday. They produced the legislation dated 2000 and signed by Jack Straw, they also produced legislation signed by the same individual, which ruled out any appeal. The attitude was that I could do nothing about it.
So I appealed on the basis that my human rights were being abused as I was being discriminated against because of my day of birth, I also appealed under the same human rights legislation that I was being denied justice because of the no appeal legislation they had introduced.
There is a lot to this and I will keep it short, but by putting people into 7 day groups, only 1 of the 7 actually gets a correct payment, the other 6 are discriminated against by varying amounts.
If I am correct the DWP have 'defrauded' pensioners out of a quarter of a billion pounds in the past 10 years. I am still awaiting the correct figures which I have requested under the Freedom of Information Act.
I have also made contact with the Conservative shadow DWP woman who's name I forget. She had no interest in putting matters right and I now consider the Conservatives complicit with Labour.
As you will probably understand it has all gone quiet on the DWP front so I am about to write to the media. I have just send a hurry up to the DWP who claim to respond within 10 days and I lodge a formal complaint whenever they fail. A dead slug would make quicker progress than the DWP.
