Yes
Border force boats should be removed from the Dover area for starters. All they do is act as unpaid ferries. If they are going to be used there than their role should be to return the boat passengers to France. If France won't let them land then put them back in their boats in the Bay of Biscay and point out France.

Supporting leave is not racism. Don't let others suggest it is.

Maritime law requires that all vessels are legally bound to come to the aid of another vessel that is in distress, if requested to do so.

Maritime law does not require vessels to be permanently positioned in any particular area in case a vessel gets into distress.

There is no legal requirement for the French & the British to have a permanent presence in the Channel for dedicated escort & rescue duties.

You are absolutely correct - only if requested to. They cannot board or take control of a dingy if no request is made.
The French Navy is there only to observe and report AND give assistance if asked. It would be a poor do if the French just turned round and disappeared knowing that the boat was over loaded and liable to sink at any time. Besides which they are well within their rights to patrol French waters at any time any where.
The same duty applies to the Brits. Once that dingy reaches our waters we then have the same duty of care. However when we turn up they will ask for assistance which we are bound under Maritime Law to give.

The escorting of these boats is not intentional - they are there because they believe that there could be an issue with the dingy sinking. Would you expect the Brits to just ignore them some 11 miles out at sea?

The small craft undocumented migrants must be in breach of some law.

Of course they are - Immigration Law unless the little boat is known to have been stolen or there is a suspicion that it is carrying an illegal cargo.
France isn't Russia where it is illegal to leave a country.

Yes

Just imagine the headlines in the press. 'Little boat full of refugees sinks and all perish whilst Border Patrol turns a blind eye'. That would go down well.

Border Patrol could be off somewhere else dealing with some other "emergency".

For what bloody good it does it may as well be disbanded and the boats flogged off to a country that has a frigging clue what border security actually means.

You're quite correct it would be a totally unacceptable situation & would deserve bad publicity.

However the headline could read "Despite the best efforts of the UK authorities, who diverted a Border Patrol craft to go the the aid of a sinking dingy, the little craft sank with the loss of life of all those on board.

The UK authorities have said that this incident should serve as a warning to those attempting to make this crossing that help may not arrive in time."

All your posts revolve around the Border Force having a 24/7/365 presence in the Channel, between Dover & Calais.

It wouldn't happen Diasi. We know that those concerned French patrols are watching over them. If they started to sink then surely the brave French matelots would rescue them and take them back to safety in la Belle France..

As an off topic aside I think the spell checker on this tablet knows something about sailors. It split matelots into mate lots.

Of course escorting these boats is intentional.
The French intentionally escort the illegals to ensure they don't come to grief.
The Border Service, (let's not call them Force  :) ) intentionally go out to bring the illegals to UK shores.

It happens most days,  the escorting actions are pre planned so must be intentional.

As much as I wish they did not come here it is Hobsons choice we cannot just turn a blind eye and hope they do not try, the fact is they are desperate to get here, no way should we hope they drown or let them drown.

If they are genuine refugees and some will be we have no choice but to accept them, to return them to their own lands would mean certain death for some of them, the EU needs to try and solve the problem not simply pass the buck to us.

Because its Hobson Choice they have crossed numerous countries to get to France in order to get to the UK thanks to the EU's freedom of movement no borders policy, IMO legally they should not get as far a France, let alone the UK

It is the EU's problem caused by the dreadful and in some cases murderous Governments that these refugees and migrants are running away from, they are the cause of the problem but the rest of the world still trades with them

The passengers pay for their seat by buying the boat inflatable whatever, from human traffickers that is why most of them are overloaded bums on seats, small boats have been stolen in the past most apparantly are not
